AM Fine Art Privacy Notice and Cookie Statement

1. Who we are
Anthony Mortimer Fine Art (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Service.  Unless otherwise indicated below, this Privacy Policy applies to any website that references this Privacy Policy, any Company website, as well as any data the Company may collect across partnered and unaffiliated sites.  

For purposes of this Agreement, “Service” refers to the Company’s service which can be accessed via our website at www.amfineart.co.uk. The terms “we,” “us,” “our” and “AM Fine Art” refer to the Company. “You” refers to you, as a user of Service.

2. Consent
By accessing our Service, you accept our Privacy Policy and Terms of Use, and you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. In addition, by using our Service, or services across partnered and unaffiliated sites, you are accepting the policies and practices described in this Privacy Policy. Each time you visit our website, or use the Service, and any time you voluntarily provide us with information, you agree that you are consenting to our collection, use and disclosure of the information that you provide, and you are consenting to receive emails or otherwise be contacted, as described in this Privacy Policy. This Privacy Policy applies to all users of the website and the Service.

3, The types of data we collect

a. Personal Information. We collect personal information (e.g., name, email address, phone number, etc.) when you:
-    purchase via our online shop;
-    sign-up to our mailing list/newsletter;
-    post a comment on a blog post
-    Submit a comment via the contact me form

b. Billing information. If you purchase a piece of artwork we require your billing information in order to process the transaction. Billing information includes your name, address, telephone number, credit/debit card details and other information necessary to process the transaction.

We will retain the last 4 digits of your credit card number, credit card type, name, address, and some other billing information, so that you may identify that card used in the future. We do not store your full credit card number or CVV2; this information is discarded after your transaction has been processed.

All transactions are processed over an industry standard SSL/TLS connection, with a minimum of 128-bit encryption.

c. Other User Information. In addition, we may also track information provided to us by your browser or by our mobile application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you.  We use this information for, among other things, the operation of the Service, to maintain the quality of the Service, to provide general statistics regarding use of the Service and for other business purposes

d. Cookies and Tracking Technologies.
We track No-Personal Information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal Information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis.  We may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser. Persistent cookies can be removed by following your Internet browser help file directions. If you choose to disable cookies, some areas of the Service may not work properly.

We partner with a third party to either display advertising on our Service or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on our Service and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here.

If you are located in Europe, for more information about targeted advertising or to opt out of having your browser information used for these purposes, please click here or change your cookie preferences on your browser or device settings. Please note this does not opt you out of being served ads. You will continue to receive generic ads.

Mobile Advertising: You can opt out of having your mobile advertising identifiers used for certain types of Interest Based Advertising by accessing the settings in your Apple or Android mobile device and following the most recent published instructions.

e. Third Party Analytics Services. Some parts of our Service use third party analytic services to help us create a better user experience.
-    Flurry. You can opt-out of Flurry’s mobile analytics service at Flurry Opt-Out. The opt-out is specific to Flurry activities and does not affect the activities of other ad networks or analytics providers we may use. When you opt-out, Flurry will stop tracking data for the device identified by the provided MAC address and/or device identifier going forward and Flurry analytics tracking will stop across all applications within the Flurry network.
-    Google. Visit the Google Analytics Opt-Out page and install the add-on for your browser.

f. Do Not Track. Currently, we do not support Do Not Track or “DNT.” DNT is a preference you set in your web browser to tell visited Sites you do not want to be tracked. You can enable or disable DNT through the preferences or settings of your web browser.

g. Mailing Lists
As part of the registration process for our email newsletter, we collect personal information.  We use that information for a few reasons:
-    To tell you about the latest posts on our website.
-    To contact you if I need to obtain or provide additional information.
-    To confirm that my records are right.
-    To check every now and then that you are happy and satisfied.
-    Monitor and prevent fraud and abuse
We use a third party provider, MailChimp, to deliver our newsletter.  We gather statistics around email opening and clicks using industry standard technologies to help monitor and improve my newsletter.  If you wish to find out more then please read MailChimp’s privacy notice.

You can unsubscribe from the updates at any time you wish by clicking the unsubscribe link at the bottom of any of our emails or by simply emailing us.

4. Weebly
Our Service is hosted by Weebly, Inc. (“Weebly”).  Weebly provides us with the online e-commerce platform that allows us to provide the Service to you.  Your information, including Personal Information, may be stored through Weebly’s servers.  By using the Service, you consent to Weebly’s collection, disclosure, storage, and use of your Personal Information in accordance with Weebly’s privacy policy available at https://www.weebly.com/privacy.    

5. Information Use, Sharing, Disclosure, and Retention

a. Use. Use of Personal Information: When in line with the preferences you have shared with us (e.g newsletter sign up) we will provide you with information or advertising relating to our Service, to complete a transaction, to operate or improve the Service, to detect fraud or compliance with export regulations, or to do something that you have asked us to do.

We use the Other Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Service (for example, by generating analytics about how our customers browse and interact with the Service, and to assess the success of our marketing and advertising campaigns).
IP addresses, browser and session information may be used to:

-    Diagnose and prevent service or technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP.
-    Estimate the total number of users from specific geographical regions using the Service.
-    Help determine which users have access privileges to certain content, services, or resources that we offer.

b. Sharing.
We do not share personal information we learn about you from your use of the Service with others except as described in this notice.

We may share your personal information where it is necessary to complete a transaction, to operate or improve the Service, to detect fraud or compliance with export regulations, or to do something that you have asked us to do. We use other third parties such as payment processors to bill you for goods and services. These third parties are authorized to use your personal information only as necessary to provide these services to us and are prohibited from using your personal information for promotional purposes.

If you enter a competition, sweepstake, or contest we may need to share your details with the prize sponsor for prize fulfilment.

Unless we have your permission, we do not share, sell, rent, or trade personal information with third parties for their promotional purposes.

c. Disclosure.
We may disclose personal information about you under the following circumstances:

In certain situations, we may disclose personal data in response to lawful requests by public authorities, including but not limited to national security or law enforcement requests. We may also disclose your personal information as required by law, such as to respond to subpoenas, court orders, or similar legal processes, to establish or exercise our legal rights or, defend against legal claims, or if in our judgment in such circumstances disclosure is required or appropriate.
If we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our various terms of use, or as otherwise required by law.

d. Retention. When you place an order through our Service, we will maintain your Order Information for our records unless and until you ask us to delete this information.

6. Links to 3rd Party Sites
As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Service. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.

7. Confidentiality and Security
We implement reasonable precautions and follow industry best practices in order to protect your Personal Information and ensure that such Personal Information is not accessed, disclosed, altered or destroyed.  However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such precautions. By using our Service, you acknowledge that you understand and agree to assume these risks.

If we learn of a security system breach we will attempt to notify you electronically so that you can take appropriate protective steps. By providing personal information to us, you are consenting to us communicating with you electronically regarding security, privacy, and administrative issues related to your use of this Service.

If you post any comments or content on this Service, any personally identifiable information you choose to provide there may be read, collected, or used by other users of the Service, as well as other parties.

8. Age of Consent
By using the Service, you represent that you are at least 18 years of age.  

9. Merger or Acquisition
In the event we (or Weebly) undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our (or Weebly’s) assets may continue to process your Personal Information as set forth in this Privacy Policy.

Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

11. Changes to this Privacy Notice
This policy was created on 18th May 2018 and we may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
